The Employees Club of California, herein refers to as the “Club”, is committed to protecting your privacy and developing technology that gives you the most powerful and safe online experience. This Statement of Privacy applies to the Club’s website and our online eNewsletters and governs data collection and usage. By using the Club website, you consent to the data practices described in this statement.

Collection of your Personal Information

The Club collects personally identifiable information, such as your e-mail address, name, billing or work address or telephone number. The Club collects anonymous demographic information, which is not unique to you, such as your ZIP code. The Club also collects member opt-in email addresses at the time of insurance and/or benefit enrollment to provide members with: (a) membership updates; and, (b) benefits that may become available to the member.

There is also information about your computer hardware and software that is automatically collected by the Club. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used by the Club for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Club’s website.

The Club encourages you to review the privacy statements of websites you choose to link to from the Club so that you can understand how those websites collect, use and share your information. The Club is not responsible for the privacy statements or other content on websites outside of the Club.

Use of your Personal Information

The Club collects and uses your personal information to operate the Club website and deliver the services you have requested. The Club also uses your personally identifiable information to inform you of other products or services available from the Club and its affiliates.

The Club does not sell, rent, or lease its member lists to third parties. The Club may, from time to time, contact you on behalf of external business partners about a particular offering that may be available to you as a qualified member. In those cases, your unique personally identifiable information (e-mail, name, address, telephone number) is not transferred to the third party. In addition, the Club may share data with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to the Club, and they are required to maintain the confidentiality of your information.

The Club keeps track of the websites and pages our members visit to determine what Club benefits and services are the most popular. This data is used to deliver customized content and advertising within the Club to members whose behavior indicates that they are interested in a particular subject area.

The Club websites will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on the Club or the Club’s websites; (b) protect and defend the rights or property of the Club; and, (c) act under exigent circumstances to protect the personal safety of members of the Club, or the public.

Use of Cookies

The Club website uses "cookies" to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalize the Club webpages, or register with the Club site or services, a cookie helps the Club recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. When you return to the same website, the information you previously provided can be retrieved, so you can easily use the Club’s features that you customized.

If you choose to decline cookies, you may not be able to fully experience the interactive features of the the Club services or websites you visit.

Security of your Personal Information

The Club secures your personal information from unauthorized access, use or disclosure. The Club secures the personally identifiable information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol.

Emails and SMS/Text Notification

By providing your email address or wireless telephone number in any of our online or printed enrollment forms, you agree to receive, through electronic email or SMS text messages, all disclosures, billing statements, benefit statements, membership reminders, insurance premium updates, and other important information and notices pertaining to your membership with the Club.

We collect the following personal information about you in the context of our text messaging program: your name, mobile phone number, and texting preferences. We use this information to manage our text messaging program, which includes sending you text messages regarding benefits that become available to you and is in no condition of any purchases. Your wireless carrier may collect data about your wireless device usage, and its practices are governed by its own policies. Text message and data rates may apply.

Opt-out of promotional emails from the Club

At the Club, we take anti-spam compliance very seriously. Our compliance with the CAN-SPAM ACT helps ensure we maintain our reputation and white-list status with major ISPs and whitelisting programs, which in turn, will ensure that our members receive high deliverability rate and get the most out of our membership benefits.

The Club adheres to the CAN-SPAM ACT requirement for commercial emails by meeting the following criteria:

  • Accurately identify the Club as the sender in the header information.
  • Use subject lines that accurately represents the content of the email.
  • Send promotional emails to members and subscribers who expressed consent (opt-in).
  • Include our physical mailing address in the promotional email.
  • Provide the subscriber with an “unsubscribe” link to opt-out from receiving future emails.
  • Honor opt-out requests promptly within 10 days and ensure our unsubscribe mechanism is operational for at least 30 days after the mailing.

All promotional emails sent by the Club will include a return email address and all promotional emails sent will contain an “unsubscribe” link which instantly opts-out the member from applicable subscription list. Members and subscribers may alternatively communicate to opt-out of receiving promotional email by calling the Club at (800) 464- 0452 or emailing the Club at info@employeesclub.com.

Changes to this Statement

The Club will occasionally update this Statement of Privacy to reflect company and customer feedback. The Club encourages you to periodically review this Statement to be informed of how The Club is protecting your information.
